Writing a will
A will (Testament) lets you depart from the statutory order of succession — within the limits set by forced heirship.
Forms of will
- Holographic will — written entirely by hand, dated, and signed by the testator.
- Public will — recorded by a notary in the presence of two witnesses.
- Oral will — permitted only in exceptional emergencies.
The disposable portion
Certain heirs are entitled to a protected minimum share (the forced heirship portion). Whatever remains is the freely disposable portion, which you may leave to anyone you choose.
